Terms of service.
These Terms govern your purchase and use of Scanmarker reading pens, the Scanmarker web, mobile, and desktop applications, and any related services. By using Scanmarker, you agree to these Terms.

1. Introduction
Scanmarker Ltd. (“Scanmarker,” “we,” “us”) provides reading pens, companion software, and online services (the “Services”) to individuals, families, schools, districts, and other institutions. These Terms apply to everyone who uses the Services, whether you purchased directly from scanmarker.com or through an authorized reseller. Schools and districts that purchase under an institutional license may have additional terms in a separate agreement; those terms control to the extent they conflict with these.
2. Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for activity on your account, including authorized use by family members or students using a device registered to you. If you become aware of unauthorized access, please notify us at support@scanmarker.com so we can help secure your account.
3. Purchases, billing, and shipping
Prices are shown in U.S. dollars unless otherwise noted. Sales tax is calculated at checkout based on the shipping address. We accept major credit cards, ClassWallet, purchase orders from approved institutions, and quotes for volume orders. Shipping is free on consumer orders over $50; institutional orders ship per the terms of your purchase agreement.
Returns are accepted within 30 days of delivery for unopened products and within 14 days for opened products in resalable condition. We do not charge a restocking fee for the first return per household per year. Bundle returns must include every component in the bundle.
4. License to use the Services
We grant you a limited, non-exclusive, non-transferable license to use the Scanmarker software and online services for personal or institutional use as permitted by your purchase. You may not reverse-engineer the firmware, redistribute the software, or use the Services to build a competing product. Open-source components are licensed under their own terms, which are listed in our open-source attributions page.
5. Acceptable use
Do not use the Services to scan or process material you do not have the legal right to access; to harass or harm others; to attempt to disrupt the Services; or in any manner that violates applicable laws. Exam-lock mode is provided for use under accommodation policies — using it to bypass an assessment's rules where accommodation has not been granted may violate exam-board policies and is your responsibility.
6. Warranty and limitation of liability
Scanmarker reading pens come with a 1-year limited hardware warranty covering manufacturing defects. Schools and districts receive an extended 3-year warranty under institutional licenses. The Services are otherwise provided “as is” without warranties of any kind. To the maximum extent permitted by law, our liability for any claim arising out of the Services is limited to the amount you paid for the product or service giving rise to the claim in the 12 months preceding the claim.
7. Termination
You may stop using the Services at any time. We may suspend or terminate your account if you breach these Terms or use the Services in a way that creates risk for other users. On termination, your right to use the Services ends but your rights to data export described in our Privacy Policy continue.
8. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you by email or through the Services at least 30 days before the change takes effect. Continued use after the effective date means you accept the updated Terms.
